DownloadA: Go to the bank to open a “Club or an Unincorporated tax exempt association/faith based association/ministry/church” account, once that is complete you can use this account to open PayPal, Venmo or any online banking apps.
In opening a bank account, the best words to use are: unincorporated entity, and religious organization or church, or ministry. Let them know your EIN number, many banks will like to have the founder's Social Security numbers in order to set up the account.
Many credit unions like to know their members and are very supportive of private member associations. They will like to see a copy of your by-laws and certificate of execution. Usually, they will keep a copy of these in your file. The Articles of Association are internal documents, we as advisors suggest to not show them to the bank.
A: They can just make a donation to your PMA in the investment amount. And you can write them a receipt for a tax exemption. Any other type investment would be written up between members as a private contract. Also Meeting Minutes to show that the investment was initiated and voted on and excepted adding in details of the agreement.
A: Properly drafted documents, will state that no trustee is liable ... that only the Association is responsible. AND, your members are agreeing to keep all business in the private domain/not to sue/etc. If you choose to get insurance you can but not necessary.
A: Trademarks are public domain process. Anything you previously have Trademarked/Copyright and you want to put it under your PMA/Ministry you would just mark it down in the Trustees ministries, that you are adopting this Intellectual Property of the PMA, ultimately you are the Authority on how it is managed. Also, do not steal other peoples logos or names, do a through search before choosing your name, it is also just confusing to the public and that is bad for marketing.
A: The landlord does not need to be a PMA and while it's nice, they don't have to be a member, they are renting to a private organization doing private business and have no right having a say in what the organization does as long as it's legal/lawful (whatever the right word is since there's always discussion about those two being technically different). The PMA is not open for public accommodation and does not have to comply with public accommodation laws or mandates.
